By using or accessing this website, you agree to be bound by this agreement. If you do not agree to these Terms of Use, you should not continue to use this Seite.  The following Terms and conditions can be changed at any time with a corresponding notification to you.  Be sure to check this Terms of Use Agreement regularly for updates. Your use of the Website means that you have accepted all amended terms of this Terms of Use Agreement.

Our website and all its content (including but not limited to articles, texts, photos, images, illustrations, graphics, video material, audio material and software (all together the "Intellectual Property"), are protected by copyright, trademark and other laws of the United States and by international conventions and the laws of other countries.The intellectual property is owned or controlled by Topgolf or the party credited as the intellectual property provider.
In addition, the Website itself is protected by copyright as a collective work and/or compilation.
Use of this website does not create any licence or other right in any trademark, service mark, copyright or other intellectual property or other right of Topgolf or any third party, and nothing contained on this website shall be construed as creating or conferring by implication, estoppel or otherwise any such right in you.This website is provided free of charge and is for informational purposes only and does not create a business or professional services relationship between you and Topgolf.

3. the purchase of memberships online

Currently, Topgolf offers its customers the opportunity to purchase lifetime memberships or monthly memberships (a "Monthly Membership") and credit for use at these locations only at select locations. In order to purchase a membership and/or credit online, you must provide Topgolf with your name, email address and credit or debit card (the debit card must bear the VISA®or MASTERCARD®logo) for the payment method you are using for the purchase (hereinafter referred to as your "Payment Card").

By applying for Topgolf membership and accepting the benefits of Topgolf membership, you agree to the terms and conditions found in the Membership Agreement.
Monthly membership:  If you choose a monthly membership, you agree that as a condition of your continued membership with Topgolf, you authorise Topgolf or its agents to use your payment card to pay for your membership;You authorise Topgolf or its agent to charge your payment card on each monthly anniversary of your membership at the applicable monthly membership fee (plus applicable taxes) until your monthly membership is cancelled as set forth in the Membership Agreement. For example, if your paid monthly membership started on 19 June, your recurring monthly date will be the 19th of each month and your payment card will be charged the monthly recurring membership fee on that date each month. If your periodic monthly date falls on a date that is not included in the relevant month (e.g. if your paid membership started on the 31st of a month), your payment card will be charged on the first day of the following month.  You will not receive copies of charge slips evidencing the recurring charges to the relevant periodic membership fee.You agree to pay the monthly periodic membership fees (plus taxes) in accordance with your payment card issuer's agreement, if applicable.You also authorise Topgolf to charge your payment card for any other fees you incur in connection with your monthly membership.
Applicable fees.You also authorise Topgolf to make an outstanding charge to your payment card when you sign up for a membership (both lifetime membership and monthly membership) and prior to any subsequent regular charges for monthly memberships. Pending debits are used to verify your billing address and the validity of your payment card, are temporary (usually for 3 to 7 days) and are not converted into an actual debit.However, outstanding charges will reduce the available balance on your payment card by EUR 1 per outstanding charge for as long as they remain outstanding.
Fees related to your payment card.You are solely responsible for all fees charged to your payment card by the issuer, bank or financial institution, including, but not limited to, fees for membership, overdraft, insufficient funds and credit limit overruns.
Expiry date and refusal of debits from your payment card.If your payment card reaches its original expiry date, your failure to cancel your monthly membership will be deemed to be an authorisation for Topgolf to continue to charge this payment card.If for any reason your payment card does not accept charges for a regular membership fee, you have 10 days from the date your payment card was declined to update your payment card information by either resolving the issue with the payment card issuer or providing new payment card information on the website. If Topgolf is able to charge your payment card (an existing one or a new one if you have provided new payment card details) within the 10-day period and all outstanding Topgolf membership fees are paid, the benefits of the monthly membership will continue without interruption and that payment card will be used to charge the relevant regular membership fees;will be used to charge the appropriate regular membership fee for each successive renewal period until your monthly membership is cancelled (your original monthly date will continue to apply) and will be your payment card for all purposes.  If Topgolf is unable to charge your payment card (existing or new if you have provided new payment card information) within the 10-day period, your monthly membership will be suspended indefinitely, beginning on the 11th day after the cancellation date.In the 30 days immediately following the day of suspension, Topgolf may attempt to charge the payment card every 10 days for the regular membership fee.   If the charge is accepted, your monthly membership benefits will be reinstated from the date the charge is accepted.This debit date will now become your new regular anniversary date and the payment card will be used to debit the corresponding regular membership fee for each consecutive anniversary;for each successive renewal period until your monthly membership is cancelled in accordance with the Membership Agreement and will be your payment card for all purposes.
